The following cases were heard by Hon. Linda Armstrong in Spencer County Distrit Court Sept. 9, 2010.

Traffic:

Steven D. Howe, speeding 19 mph over limit. $180.

Glen R. Jackson, Jr., speeding 13 mph over limit. $168.

Ashley N. Nash, speeding 17 mph over limit. $177.

Robert A. Tomes Jr., speeding 15 mph over limit. $143 court cost and state traffic school.

Adan O. Alverez, no operators/moped license. Amended to resident not to use operators license from another state. $173 court cost and fine.

Aaron R. Bowling, speeding 22 mph over limit. $143 court cost.

Cory D. Chesser, speeding 26 mph over/greater. $237 court cost and fine.

Rodney B. Chesser, failure of non-owner operator to maintain required insurance. $643 court cost and fine; $400 conditionally discharged with 12 month insurance monitoring.

Hubert R. Cornett, failure of non-owner operator to maintain required insurance; and failure to wear seat belts. $668 court cost and fines; $400 conditionally discharged with 12 months insurance monitoring.

David A. Garcia-Verastegui, no operators/moped license; and failure of non-owner operator to maintain required insurance. $693 court cost and fines; $400 conditionally discharged with 12 months insurance monitoring.

Jennie M. Nyhus, operating a motor vehicle under/influence of alcohol/drugs, aggravator, second offense; and leaving the scene of an accident/failure to render aid. Second charge merged. $878 court cost and fine; sentenced to 30 days with 14 days served; suspension of operators license for 12 months; and alcohol drug education program.

Cody W. Robinson, operating a motor vehicle under/influence of alcohol/drugs, second offense; and reckless driving. First charge amended to under 21 DUI. Second charge merged. $243 court cost and fine; 30 days suspension of operators license; and alcohol drug education program.

Jefferey S. Rummage, failure to or improper signal; and operating a motor vehicle under/influence of alcohol/drugs, aggravator, first offense. First charge merged. Second charge amended to no aggravator. $728 court cost and fine; 30 day suspension of operators license; and alcohol drug education program.

Justin B. Stephens, careless driving. $143 court cost and state traffic school.

David K. Zeitz, speeding 16 mph over limit; failure of owner to maintain required insurance; and operating on suspended/revoked operators license. Third charge was amended to no license in possession. $695 court cost and fines; $400 conditionally discharged with 12 months insurance monitoring.

Alan C. Elliott, operating a motor vehicle under/influence of alcohol/drugs, first offense; and failure to notify address change to department of transportation. Second charge merged. $728 court cost and fine; 60 days suspension of operators license; and alcohol drug education program.

William T. Poole, speeding 26 mph over/greater. $222 court cost and fine.

Misdemeanor:

Jason L. Hartley, possession of marijuana; and operating a motor vehicle under/influence of alcohol/drugs, first offense. First charge was merged. $728 fines and court costs; suspension of operators license for 30 days; and alcohol drug education program.

Marcus S. Barbour, resident fishing without a license/permit. $153 court cost.

Mark D. King, non-approved/insufficient number of personal float. $153 court cost.

Jerry W. Clark, Jr. three counts of theft by deception, including cold checks under $500. $183 court cost; sentenced to 12 months; probated for two years. Restitution review scheduled for March 11, 2011.

Greg D. Haynes, alcohol intoxication in a public place, first and second offense. $178 court cost and fine.
