The following case was heard by the Hon. Donna Dutton in Spencer County District Court July 20, 2010.

Traffic:

Oscar William Payne, operating a motor vehicle under/influence of alcohol/drugs, first offense. Amended to alcohol intoxication in a public place. Guilty. $143 court cost and $100 to Shop with a Cop.

The following cases were heard by the Hon. Donna Dutton in Spencer County District Court July 23, 2010.

Traffic:

Brandon T. Clark, failure to wear seat belts. Guilty. $25 fine.

Misdemeanor:

Joshua J. Ferguson, possession of marijuana; failure to wear seat belts; and license to be in possession. Guilty. $198 court cost and fine; 30 days incarceration, conditionally discharged; and drug screenings by Kentucky Alternative Program.

Brooke Gearlds, theft by unlawful taking, gasoline under $500. Guilty. $153 court cost; 180 days incarceration conditionally discharged after two years; Kentucky Alternative Program; and $53.38 restitution.

Felony:

William R. Goodwin, operating a motor vehicle under/influence of alcohol/drugs, second offense; possession of open alcohol beverage container in a motor vehicle; driving DUI suspended license, first offense, aggravator; possession of non-narcotic controlled substance, second degree; use/possession drug paraphernalia, first offense; possession of controlled substance, first degree; and unlawful possession of methamphetamine precursor, first offense. Found guilty of all charges Feb. 6, 2009. Defendant to serve 44 days, plus 102 days for probation violation; and $883 court cost and fines.

Brooke Gearlds, burglary, third degree. Amended to criminal trespassing. Guilty. $153 court cost; 180 days incarceration, conditionally discharged; quarterly reviews by Kentucky Alternative Program; $300 restitution.

The following case was heard by the Hon. Linda Armstrong in Spencer County District Court July 27, 2010.

Civil:

Kelly B. Rigsby v. Jason Patterson. Judgement for the plaintiff.

The following cases were heard by the Hon. Linda Armstrong in Spencer County District Court July 30, 2010.

Traffic:

Emilio C. Lorenzo, speeding 25 mph over limit; and reckless driving. Guilty. $163 court cost and fine; and state traffic school.

Troy R. Netherton, excessive windshield/window tinting; and obstructed vision and/or windshield. Guilty. $183 court cost and fine.

Chad A. Reece, failure to wear seat belts. Guilty. $25 fine.

Tami L. Sander, speeding 16 mph over limit. Guilty. $175 court cost and fine.

Josh R. Burke, driving on DUI suspended license, first offense. Amended to no license in possession. Guilty. $173 court cost and fine.

Jonetta Crusott, speeding  15 mph over limit. Guilty. $143 court cost and state traffic school.

Jeremy L. Goss, one headlight; operating a motor vehicle under/influence of alcohol/drugs, first offense; and possession of open alcohol beverage container in a motor vehicle. Charges one and three were merged into charge two. Guilty. $728 court cost and fine; 30 day suspension of operators license; and alcohol drug education program.

Brian T. Harmon, speeding 16 mph over limit. Guilty. $175 court cost and fine.

Joseph L. Loveless, possession of open alcohol beverage container in a motor vehicle; and operating a motor vehicle under/influence of alcohol/drugs, second offense. Guilty. $878 in court cost and fines; 14 days home incarceration program; alcohol drug education program; and operators license suspended for 12 months.

James T. Porter, operating a motor vehicle under/influence of alcohol/drugs, second offense. Guilty. $878 court cost and fines; seven days served; alcohol drug education program; and operators license suspended for 12 months.

Troy E. Robinson, operating a boat/watercraft under/influence of alcohol, first offense. Guilty. $253 court cost and fine; and complete safe boating class.

James A. Wehrley, operating a motor vehicle under/influence of alcohol/drugs, first offense. Guilty. $728 court cost and fine; operators license suspended 30 days and alcohol drug education program.

Aaron B. Horrar, speeding 26 mph over/greater. Amended to 25 mph over limit. Guilty. $198 court cost and fine.

Misdemeanor:

James P. Ball, alcohol intoxication in a public place, first and second offense; and fleeing or evading police, second degree (on foot). Second charge was merged. Guilty. $178 court cost and fine.

Stephen A. Bockting, assault fourth degree, no visible injury; and criminal mischief, second degree. Second charge was merged. Guilty. $153 court cost; 10 days incarceration, conditionally discharged for one year; and no contact with victim.

James A. Carney, failure to wear seat belts; possession of marijuana; and use/possession of drug paraphernalia, first offense. Guilty. Sentencing set for Aug. 27, 2010.

Adam P. Clements, possession of marijuania; and use/possesion of drug paraphernalia, first offense. Guilty. $153 court cost; $100 to Spencer County Drug Intervention Fund; 365 days incarceration, two days served, credit for time served.

Wanda J. Hahn, alcohol intoxication in a public place, first and second offense; and drinking alcoholic beverage in a public place, first and second offense. Charge two was merged. Guilty. $178 court cost and fine.

Ashley N. Miller, assault fourth degree domestic violence minor injury. Amended to harassment with physical contact. Guilty. Nineteen days, credit for time serve.

Jonathan D. Taul, alcohol intoxication in a public place, first and second offense. Guilty. $153 court cost.

Lance A. Cordray, assault fourth degree  domestic violence no visible injury. Guilty. $153 court costs; 180 days incarceration, conditionally discharged in two years.

Thomas Lee Ethington, III, operating a motor vehicle under/influence of alcohol/drugs, first offense. Guilty. $728 court cost and fine; operators license suspended  for 30 days; and alcohol drug education program.
