The following cases were heard by the Hon. Linda Armstrong in Spencer County District Court July 2, 2010.

Traffic:

Stuart D. Bray, speeding 10 mph over limit. $143 court cost and state traffic school.

Charles L. Barnett, careless driving and improper passing. $163 court cost and fine; and state traffic school.

Cedrick T. Hall, failure to wear seat belts; and operating a motor vehicle under/influence of alcohol/drugs, aggravator, first offense. Second charge amended to no aggravator. $728 court cost and fines; 30 days incarceration conditionally discharged in two years; suspended operators license for 30 days; and alcohol drug education program.

Elmer L. Patton, failure to wear seat belts; failure of owner to maintain required insurance; and license to be in possession. $1,045 in fines with $900 conditionally discharged after two years insurance monitoring.

Jessica Stacy, failure to wear seat belts. $25 fine.

Misdemeanor:

William H. Hill, alcohol intoxication in a public place, first and second offense; and driving DUI suspended license, second offense. Second charge was amended to no license in possession.  $203 court cost and fines.

Jesse L. Jones, possession of open alcohol beverage container in a motor vehicle; and possession of marijuana. $188 court cost and fine; defendant to attend marijuana education class and reviewed August 27, 2010.

Ryan L. Jones, alcohole intoxication in a public place, first and second offense; and possession of marijuana. $188 court cost and fine; and defendant  to attend marijuana education with a review August 27, 2010.

Jonathan Corey Monday, theft by unlawful taking, shoplifting. $228 in court cost and fines; and no contact with Family Dollar store.

Lisa Thompson, three counts of theft by deception, including cold checks under $500. Pled guilty. Sentencing to be December 17, 2010.

Samuel Coleman Voorhees, alcohol intoxication in a public place, first and second offense; and fleeing or evading police, second degree (on foot). Second charge was merged. $178 court cost and fine.

Anthony R. Walker, public intoxication controlled substance, excluded alcohol. Amended to alcohol intoxication. $153 court cost. Ten days incarceration in lieu of $25 fine.

Richard A. Elliott, failure to wear seat belts; failure of non-owner operator to maintain required insurance; drinking alcohol beverage in public place, first and second offense; and possession of open alcohol beverage container in a motor vehicle. Fourth charge merged. $693 in court cost and fines with $400 conditionally discharged after 12 months insurance monitoring.

Felony:

Adam C. Boguskie, disregarding traffic control device; operating motor vehicle under/influence of alcohol/drugs, third offense; possession of marijuana; use/possession of drug paraphernalia, first offense; driving on DUI suspended license, first offense; criminal littering; tampering with physical evidence; and failure to surrender revoked operators license. Charges one, three and four were merged into charge two. Charge eight was merged into charge 7. Charge nine was merged into charge 6. Charge six  was amended to operating on a suspended license. $1,038 in court cost and fines; 90 days incarceration; 48 days home incarceration program; suspended operators license for two years; alcohol drug education program; and $100 to Spencer County Drug Intervention Fund.

Arnulfo Z. Herrera, operating a motor vehicle under/influence of alcohol/drugs, aggravator, second offense. $878 court cost and fines; 14 days incarceration, time served; suspended operators license for 12 months; and alcohol drug education program.

Carl A. Barr, speeding 25 mph over limit; fleeing or evading police, first degree; reckless driving; and disregarding stop sign. Charges two, three and four merged into charge one. $198 court cost and fine.

Shaun C. Chesser, flagrant non-support. Amended to non-support. 365 days incarceration conditionally discharged after two years.
