The Honorable Judge Donna Dutton presided over the following cases in District Court on October 16, 2009.

Traffic:

John L. Booth (b. 1986). Operating on suspended/revoked operator’s license. Amended to no license in possession. Guilty. $20 fine plus $168 court costs.

Michael A. Chesser (b. 1985). Operating a motor vehicle under the influence of alcohol/drugs, etc., .08, first offense. Guilty. 30-day suspension of operator’s license, enroll in AEP, $728 fine and court costs.

Carl J. Conrad (b. 1989). Careless driving. Traffic school, $143 court costs.

Jeremy S. Cummins (b. 1973). Charge #1, operating a motor vehicle under the influence of alcohol/drugs, .08, second offense. Guilty. 6 months to serve, 18-month suspension of operator’s license, $1128 fine and court costs. Charge  #2, operating on suspended/revoked operator’s license. Guilty. Sentenced to 30 days concurrent, $100 fine. Charge #3, possess open alcohol beverage container in a motor vehicle. Guilty. $35 fine.

Justin M. Dohrman. Operating a boat/watercraft under the influence of alcohol, first offense. Amended to public intoxication. Guilty. $25 fine plus $153 court costs.

Cecil T. Gibbs (b. 1943). Charge #1, dismissed. Charge #2, operating a motor vehicle under the influence of alcohol/drugs, .08, third offense. Sentenced to 90 days conditionally discharged for one year, register in multiple offender program, 24-month suspension of operator’s license, $1028 fine and court costs. Charge #3, dismissed.

Sharon P. Greenwell (b. 1972). Charge #1, dismissed. Charge #2, operating a motor vehicle under the influence of alcohol/drugs, etc., .08, first offense. Guilty. 30-day suspension of operator’s license, enroll in AEP, $728 fine and court costs.

Ricky L. McClain Jr. (b. 1982). Failure to wear seat belts. $25 fine plus $25 fine for contempt of court.

Rebecca W. McCroskey (b. 1967). Operating a motor vehicle under the influence of alcohol/drugs, .08, second offense. Sentenced to 14 days home incarceration, enroll in AEP, $878 fine and court costs.

Stephanie E. Milby (b. 1981). Operating a motor vehicle under the influence of alcohol/drugs, etc., .08, first offense. 30-day suspension of operator’s license, enroll in AEP, $728 fine and court costs.

Joshua Allen Moon (b. 1980). Operating a motor vehicle under the influence of alcohol/drugs, .08, with aggravator, first offense. Amended to no aggravator. Sentenced to 30 days conditionally discharged for one year, enroll in AEP, 30-day suspension of operator’s license, $728 fine and court costs.

Angela K. Simpson (b. 1968). Speeding 15 mph over the limit. Traffic school, $143 court costs.

Andrew J. Lyons (b. 1988). Charge #1, dismissed. Charge #2, no motorcycle operator’s license. Guilty. $50 fine. Charge #3, failure to comply with helmet law under 21 years of age. Guilty. $20 fine plus $143 court costs.

Misdemeanor:

David S. Collette (b. 1987). Illegal take/pursue deer/wild turkey. Amended to attempt. Guilty. $50 fine plus $153 court costs.

Dustin M. Gray (b. 1987). Spotlighting-use of artificial light. Guilty. $150 fine plus $153 court costs.

Jeremy R. Wells (b. 1979). Charge #1, possession of marijuana. Guilty. Sentenced to 30 days conditionally discharged, random drug screenings, $100 fine plus $150 for Shop With a Cop. Charge #2, use/possess drug paraphernalia, first offense. Guilty. Sentenced to 30 days conditionally discharged. Charge #3, speeding 18 mph over the limit. Guilty. $36 fine plus $153 court costs.

Michael G. Lewis (b. 1952). Creel and  size limits for fish. Guilty. $59 fine.

Michael L. Willis (b. 1982). Possession of marijuana. Guilty. $100 fine, $150 to Shop With a Cop plus $153 court costs.

Felony:

Brian Richardson (b. 1983). Charge #1, criminal mischief 1st degree. Amended to misdemeanor charge of criminal mischief 2nd degree. Guilty. Enroll in anger management classes, pay restitution, sentenced to 180 days conditionally discharged (no contact with victim), $153 court costs. Charge #2, assault 4th degree domestic violence, no visible injury. Guilty. Concurrent.

Marty J. Waldridge (b. 1959). Charge #1, wanton endangerment 1st degree. Amended to misdemeanor charge of wanton endangerment 2nd degree. Sentenced to 365 days conditionally discharged, $100 to Shop With a Cop. Charge #2, alcohol intoxication in a public place, first and second offense. Guilty. $20 fine.
