A Spencer County Grand Jury heard the following case, and charges, in an indictment filed July 21, that:
On or between April 1, 2009 and June 30, 2011, Chad D. Goodlett, 41, 200 block of Little Union Bank, committed the offense of flagrant non-support when he persistently failed to provide support which he could reasonably provide and which he had knowledge of the duty to provide by virtue of a Spencer Circuirt Court order pertaining to his minor child, thereby accruing an arrearage of not less than $1,000 and/or failing to make payments for at least six consecutive months.
David T. Chesser, 200 block of Hardin Street, signed a waiver of rights, thereby waiving his right to a probable cause hearing in district court, his right to have the case presented to a Spencer County grand jury and his right to have any felony charges against him in Spencer County prosecuted by indictment only. Therefore, Commonwealth’s Attorney Laura Witt Donnell, based on knowledge, information and believe, accuses the defendant of the following offense, filed July 21:
On or between Nov. 1, 2009 and June 30, 2011, David T. Chesser committed the offense of flagrant non-support when he persistently failed to provide support which he could reasonably provide and which he had knowledge of the duty to provide by virtue of a Spencer Circuirt Court order pertaining to his minor children, thereby accruing an arrearage of not less than $1,000 and/or failing to make payments for at least six consecutive months.
A Spencer County Grand Jury heard the following cases, and charges, in indictments filed Sept. 8, that:
On or between Dec. 1, 2010 through May 20, Devin W. Chesser, 24, 100 block of Roy Road, committed the offense of theft by unlawful taking by taking or exercising control of property of a value of $500 or more belonging to Charles G. Parrott Jr., with intent to deprive the owner thereof.
Between Jan. 30 and May 20, Carl R. Blackburn, 27, 600 block of Tindale Drive, committed the offense of theft by unlawful taking by taking or exercising control of property having a value of $500 or more belonging to AutoZone, with intent to deprive the owner thereof.
During Oct. 14, 2009, through Jan. 15, Terrance Mattingly, 45, Taft Court, Louisville, committed the offense of theft of identity when, without the other’s consent, he knowingly possessed or used any current or former identifying information of the other person or family member or ancestor of the other person, such as that person’s or family member’s or ancestor’s name, address, telephone number, electronic mail address, Social Security number, driver’s license number, birth date, personal identification number or code, or any information which could be used to identify the person, including unique biometric data, with the intent to represent that he is the other person for the purpose of avoiding detection.
The following cases were heard by Judge William Ryan in Spencer District Court, June 3, 2011:
Traffic
William D. Whelan (1992), speeding 13 miles over the legal limit, traffic diversion agreement filed, $143 court costs.
Marcus S. White (1990), speeding over the legal limit 26 miles or more, guilty, $60 fine and court costs.
Elizabeth Wood (1981), failure of non-owner operator to maintain required insurance first, guilty, $500 fine and court costs, $400 conditionally discharged for two years, Kentucky Alternative Program.
Christopher T. Yates (1981), operating on a suspended/revoked operator’s license, guilty, 30 days to serve concurrently with work release.
Bret A. Witte (1976), speeding 10 miles over the legal limit, guilty, $20 fine and court costs.
Michael R. Smith (1982), careless driving, guilty, state traffic school and court costs.
Adam C. Snider (1990), operating a motor vehicle under the influence of alcohol/drugs, second offense, guilty, $350 fine, court costs, operator’s license suspended for 365 days, alcohol/drug education program, 14 days to serve home incarceration program, 30 days conditionally discharged for one year.
Misdemeanor:
Hung N. Le (1984), resident fishing without a license/permit, guilty, $50 fine plus court costs.
Thanh Q. Phung (1991), resident fishing without a license/permit, guilty, $50 fine plus court costs.
Michael E. Barnett (1960), alcohol intoxication in a public place, first and second offenses, guilty, $20 fine and court costs.
Jimenez Fausto (1984), resident fishing without a license/permit, guilty, $50 plus court costs.
Felony:
Christopher Yates (1981), theft by unlawful taking under $300 and third-degree criminal trespassing; guilty, sentenced 365 days to serve with work release.
