Judge Matthew Eckert heard the following cases in Spencer District Court May 17, 2013:

Traffic:
Christopher P. Caudill (1983), speeding 15 miles over the legal limit, guilty, state traffic school and court costs.

Joshua R. Huizar (1992), failure to wear seat belts, guilty, $25 fine.

Matthew R. Waits (1987), failure to comply with helment law over 21 years old, amended to no license in possession, guilty, $20 fine and court costs.

Charles A. Armstrong (1975), failure of owner to maintain required insurance/security first, guilty, $500 fine, $400 conditionally discharged for one year, court costs and insurance monitoring.

Derek P. Carter (1979), operating a motor vehicle while under the influence of alcohol/drugs aggravator first offense, amended to no aggravator, guilty, $728 fine, sentenced to 30 days conditionally discharged for two years, 30 days suspended operator’s license, alcohol and drug education program.

Bridget D. Cipolla (1976), failure of non-owner operator to maintain required insurance first, $500 fine, $400 conditinally discharged for one year, court costs and insurance monitoring.

Leonard J. Elzy Jr. (1990), failure of of owner to maintain required insurance/security first, guilty, $500 fine, $400 conditionally discharged for one year, court costs and insurance monitoring.

Steve L. Hagerman (1964), speeding 26 miles over the legal limit or greater, guilty, $60 fine and court costs.

Joshua R. Huizar (1992), operating on a suspended/revoked operator’s license, amended to no license in possession, guilty, $20 fine and court costs; possession of marijuana, guilty, sentencing to follow; drug paraphernalia buy/possess, guilty, sentencing to follow.

Joseph Lucas (1991), operating a motor vehicle while under the influence of alcohol/drugs second offense, guilty, $878 fine, 14 days home incarceration, 12 months suspended operator’s license.

Rusty S. Poole (1988), speeding 20 miles over the legal limit, guilty, state traffic school and court costs.

Darren S. Maynard (1988), driving on a DUI suspended license first offense, aggravator, guilty, 30 days conditionally discharged for two years; failure to produce insurance card, guilty, $25 fine; operating a motor vehicle while under the influence of alcohol/drugs aggravator, second offense, guilty, $878 fine, 12 month suspended operator’s license, 14 days jail, credit for time served, 14 days.

Misdemeanor:
Roberto Shanchez-Fuentes (1976), resident fishing without a license, guilty, $50 fine, court costs.

Erica D. Murphy (1982), second-degree criminal possesion of a forged instrument, guilty, sentenced to 180 days conditionally discharged for two years, court costs.

James G. Norton (1976), second-degree criminal possession of a forged instrument, guilty, sentenced to 180 days conditionally discharged for two years.

Adam J. Parks (1989), possession of marijuana, guilty, 30 days conditionally discharged for two years, $250 fines, court costs.

Denita K. Phelps (1971), theft by deception to include cold checks under $500, guilty, 30 days conditionally discharged for two years and court costs.
