Public Record: March district court and February indictments

The following cases were heard by Judge Donna Dutton in Spencer District Court March 2, 2012:

Traffic:
David A. Brooks (1973), operating a motor vehicle under the influence of alcohol/drugs first offense, guilty, 30 days suspended operators license, alcohol and drug education program, $728 fine to be paid in installments/deferred payment.

Heather L. Connor (1989), speeding 14 miles over the legal limit, guilty, state traffic school, $143 court costs paid.

Christopher J. Conway (1980), operating a motor vehicle under the influence of alcohol/drugs aggravator, first offense, amended to no aggravator, $728 fine paid, 30 days suspended operators license, alcohol and drug education program.

Michael R. Shea II (1969), operating a motor vehicle under the influence of alcohol/drugs aggravator first offense, guilty, 30 days suspended operators license, alcohol and drug education program,  eight days home incarceration program, $728 fine to be paid in installments/deferred payment.

Victoria Thomas (1969), speeding 15 miles over the legal limit, guilty, $173 paid in court costs and fines.
Russell A. Willett (1982), failure to produce insurance card, amended to failure to maintain proper insurance, guilty, $500 fine, $400 conditionally discharged, $243 in court costs and fines to be paid in installments/deferred payment.

Camill N. Taylor (1986), speeding 15 miles over the legal limit, guilty, $223 in fines and court costs, to be paid in installments/deferred payment.

Misdemeanor:
Nathan G. Coleman (no birth year provided), alcohol intoxication in a public place first and second offense, guilty, $178 fine to be paid in installments/deferred payment, to serve four days concurrently.

Damon S. Davidson (1981), fourth degree assault domestic violence with minor injury, entered alford plea, sentenced to 20 days home incarceration with a work release and no contact with the victim, $153 court costs to be paid in installments/deferred payment.

Felony:
Jeremy A. Hurd (1978), second-degree trafficking in a controlled substance, first offense, amended to attempted trafficking in a controlled substance, guilty, sentenced to 180 days conditionally discharged for one year, Kentucky alternative program, mandatory drug assessment, $153 court costs to be paid in installments/deferred payment.

A Spencer County Grand Jury heard the following cases, and charges, in indictments filed Feb. 9, 2012, that:

Between Oct. 25, 2011, and Nov. 4, 2011, Mark A. Bell, 18, 100 block of Tsueda Drive, committed the offense of second-degree burglary, by knowingly entering or remaining in a dwelling located at 86 Tsueda Drive with intent to commit a crime; and committed the offense of theft by unlawful taking by taking property of a value of $500 or more belonging to Billy and Patricia Smith.

On or about Nov. 19, 2011, Mark A. Bell, 18, 100 block of Tsueda Drive, committed the offense of second-degree burglary, by knowingly entering or remaining in a dwelling located at 85 Tsueda Drive with intent to commit a crime; and committed the offense of theft by unlawful taking by taking property of a value of $500 or more belonging to Jeffrey Wagner.

On or about March 30, 2011, Michelle Lee Monday, 39, 200 block of Little Union Road, committed the offense of first-degree trafficking in a controlled substance, classified as a Schedule II controlled substance known as methamphetamine.
